店舗を開設し、商品の販売やサービスの提供を行う場合、その商品やサービスによって様々な法的規制が課せられる場合が多い。規制内容は営業を行う場所の制限、衛生設備や消防設備が必要とされる建築物の構造、客席数の制限などがある。

日本の場合、店に関係する法規には、都市計画法（用途地域）、食品衛生法、公衆衛生法、建築物衛生法、消防法、建築基準法、旅館業法、風俗営業法、労働安全衛生法などがある。

既存の建築物を改装し、以前と異なる店舗を開設しようとしたとき、既存建築物によっては営業許可が得られない場合もあり、このような場合には、事前に専門家の調査が必要とされる。
「店」の付く言葉

店を畳む - 商売をやめる。

店子（たなこ） - テナント、賃借者。

なお、会社の登記において、一般にいう本社を法律用語では「本店」という。（例「本店の所在地」）

『史記』老子・韓非列伝（第三）において、老子が孔子に対して、「（前略）よい商人は品物を奥深くしまいこんで店は空のようにしてあり、本当に立派な人は盛徳を身につけているが、その容貌は馬鹿者のようだ、とも聞いている」と（能を隠す意で）たとえ話を聞かせており、古代中国における良い商家の店の特徴（傍から見ると奇異に映るが良品を隠している）について端的ではあるが、語っている。

商家で働く者を「店者（たなもの）」、大きな商家を「大店（おおだな）」と呼び、また、近世では支店を持つ商人を「他国店持（- たなもち）」と称するなど、日本では店と棚は文化的に密接に繋がっている。店を構えて商売する事自体を日本では、「棚＝店商い（たなあきない）」と呼ぶことからもわかる。

例えば、現在では、支店を「△△（店名）○○（地名）店（- てん）」と読むのが一般的だが、近世では、上方商人が江戸に支店を構えた場合、「江戸店＝棚（- たな）」と読むように、前近代では「てん」ではなく、「たな」の読みが一般的である。

店を「たな」と読む例として、松尾芭蕉の『薦獅子（すすめじし）』（冬）の一句に、「塩鯛の 歯ぐきも寒し 魚（うお）の店（たな）」（魚屋の棚上に鯛が歯ぐきをむき出しているが寒々とした感じに見える）がある。

学術団体については、1951年4月21日、日本商業学会が慶應義塾大学教授向井鹿松を初代会長として設立された[2]。
