王政復古（慶応3年12月9日（1868年1月3日））の際に総裁・議定・参与の三職が設置された。議定には仁和寺宮純仁親王・中山忠能・松平慶永・島津茂久・徳川慶勝・山内豊信・山階宮晃親王・正親町三条実愛・中御門経之・浅野長勲の10名が任じられ、その後岩倉具視・三条実美・伊達宗城・長谷信篤の4名が追加された。
翌年1月に三職七科制が導入されると、議定には皇族・公卿・諸侯が任命され、七科を分督して議事を決する職とされ各科の事務総督は議定が兼ね、最大31名まで増員した。更に4月に政体書に基づく職制に移行し、議定は議政官上局に移されて、法律の制定、条約の締結、和戦の宣告、三等官以上の人事を司った。また、議定であった三条実美と岩倉具視が行政官の長である輔相（定員2名）を兼務した。9月に一旦議定は行政官に属するものとされたが、翌1869年（明治2年）4月に上局に戻されるなど複雑な変遷を遂げる。
1869年（明治2年）5月に議政官が行政官に統合され、5月15日官吏公選が行われる。その結果、輔相に三条実美が、定員4名の議定には岩倉具視・鍋島直大・徳大寺実則の3名が選出された。同年7月8日（1869年8月15日）の明治太政官制の導入によって廃止された。
