この、イラクで最初に出版された著作物は ⇒第83号著作権法改正命令を2004年に改正した第3号1971年著作権法により、著作権の保護が失効しているため、イラクにおいて、パブリックドメインに置かれています。本著作物は以下の基準に合致します。


変名、又は匿名の著作物であり、出版年から50年が経過している。

著作権者が法人であり、又は応用美術であり、発行年から50年が経過している。

“compositive”でなく（本質的に芸術の分野に属し）、写真、又は映画の著作物であり、最初の出版が1999年1月1日以前である。

1954年1月1日以前にイラクで出版され、著者が1979年1月1日以前に死亡している。

上記以外の著作物で、著者の死（共同著作物であれば最後まで生存した共同著作者の死）から50年が経過している。

この著作物が、国際的な法、規則、協定、司法の裁判、又はその他公務上の文書である。

公開会社または公開会社でない会社を主体とした著作物で、1980年1月1日以前に出版されている(1971年法、第20条）。

U.S. Circ. 38a.によれば、以下に示す国は文学的及び美術的著作物の保護に関するベルヌ条約に加盟しておらず、アメリカ合衆国と著作権に関する条約を締結していません。

東ティモール、エリトリア、エチオピア、イラン、イラク、マーシャル諸島、パラオ、ソマリア、ソマリランド、南スーダン。

上記の国で上記の国民によって発行された著作物は、通常、上記の国以外では著作権の保護対象外です。ゆえにそうした著作物は、上記の国以外のほとんどの国でパブリックドメインに置かれています。
しかしながら、


ベルヌ条約やその他の著作権に関する条約に加盟している上記以外の国民・永住者の人によって、上記の国で出版された著作物は本国の著作権法のみならず国際的に保護されています。

同様に、上記の国での出版から30日以内に上記の国以外で出版された著作物も出版された国で保護の対象です。著作物が上記の国以外で保護の対象とされているとき、その著作権の保護期間は本国における保護期間を超える場合があります。

これらの国の出版されていない著作物は著作権保護下にある場合があります。

This work was created in Syria and is now in the public domain there because its term of copyright has expired pursuant to the provisions of Law No. 12/2001, Syria's first ever copyright law (details). In order to be hosted on Commons, all works must be in the public domain in the United States as well as in their source country. Syrian works are currently in the public domain in the United States if their copyright had expired in Syria on the date of restoration (June 11, 2004) and the work was published before this date.

This work meets one of the following conditions:
